1. Acceptance of Terms

By accessing or using ImageSearch.art ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

ImageSearch.art provides AI-powered reverse image search capabilities, allowing users to find where images appear online, detect duplicates, and track image usage across the web. The Service is provided on a subscription and/or pay-per-use basis.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current information and to notify us immediately at support@imagesearch.art of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized account access.

5. Acceptable Use

You agree not to use the Service to:

• Upload, search for, or distribute illegal, harmful, or obscene content
• Infringe on intellectual property, privacy, or other rights of any third party
• Stalk, harass, or harm any individual
• Attempt to reverse-engineer, decompile, or extract our AI models or source code
• Use automated bots, scrapers, or scripts to access the Service beyond permitted API use
• Circumvent rate limits, access controls, or subscription restrictions
• Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts found in violation of these terms without notice or refund.

6. Intellectual Property

The Service and its content, features, and functionality are owned by ImageSearch.art and are protected by intellectual property laws. You retain ownership of images you upload. By uploading an image, you grant us a limited, non-exclusive license to process that image solely to provide the search result you requested.

7. Payment and Subscriptions

Some features require a paid subscription or credits. Payments are processed through Paddle. By purchasing, you authorize us to charge your payment method on a recurring basis (for subscriptions) or as a one-time charge. All fees are stated in USD and are exclusive of applicable taxes. 8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, introduce changes, or experience outages. We are not liable for any downtime or data loss resulting from service interruptions.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that search results will be accurate, complete, or up to date.

10. Limitation of Liability

To the fullest extent permitted by applicable law, ImageSearch.art shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ImageSearch.art, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall do so.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as required by your local consumer protection laws.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
